A California judge has dismissed Metallica’s appeal in their multi-million dollar lawsuit over CоVID-cancelled shows. The band sought over $3 million in lost concert revenues from Lloyd’s of London, arguing that their insurance policy should cover the cancellations of six South American concerts due to pаndemic-related travel restrictions.
Metallica initially filed the lawsuit in June 2020, claiming that their standard insurance policy should cover the losses. However, the Los Angeles Superior Court ruled in favor of Lloyd’s of London, citing an exclusion in the policy for losses due to communicable diseases.
Metallica’s lawyers argued in their appeal that other factors besides the pаndemic may have contributed to the concert cancellations, pointing to venues reopening in 2022 despite ongoing CоVID concerns. Despite this argument, Justice Maria Stratton upheld the initial ruling and dismissed the case entirely. In her decision, she referenced Taylor Swift’s lyrics to illustrate the severity of the pаndemic’s impact in March 2020.
Metallica’s case is just one of many similar lawsuits filed by artists and venues affected by CоVID-related cancellations. However, such cases have often been dismissed or ruled in favor of insurers due to policy exceptions for diseаse-related events.
